UM, I I I I'M GONNA BE OPPOSED TO THIS ORDINANCE, UH, FOR THE SAME REASON THAT I OPPOSED THE, UH, THE PD AND THAT IS THAT I, I THINK I STILL THINK THAT THERE WAS AN OVERSIGHT BY THE COUNCIL IN THAT THERE IS ONE BUILDING AT THE BACK OF THIS DEVELOPMENT THAT THE SIDE OF THAT BUILDING FACES THE NEIGHBORHOOD INSTEAD OF THE BACK OF THAT BUILDING FACING THE NEIGHBORHOOD. AND AS A RESULT, THE RESTRICTIONS ON THAT PARTICULAR BUILDING ARE ONLY FIVE FEET. SO THOSE PARTICULAR NEIGHBORS COULD HAVE A TWO STORY WALL, FIVE FEET FROM THEIR PROPERTY LINE. NOW I KNOW THERE'S, THERE'S AN HOA 10 FOOT HOA SO MAYBE IT'S 10 FEET, BUT OUR INTENT WAS THAT THE BUILDINGS WOULD BE 25 FEET FROM THOSE [00:40:01] NEIGHBOR'S PROPERTY LINES. AND I, I THINK IT WAS AN OVERSIGHT, UH, IN THE PD. UM, AND UH, IT, IT IS STILL REFLECTED IN THIS ORDINANCE, SO I'M GONNA BE OPPOSED TO THIS. ALRIGHT, THANK YOU FOR THAT COUNCIL MEMBER. I'M SORRY, YOUR, YOUR, YOU'RE OPPOSED AND I'M, I'M NOT TRYING TO INFLUENCE YOUR OPPOSITION OR YOUR POSITION, BUT YOU'RE OPPOSED BECAUSE THE BUILDING IS FACING A NEIGHBORHOOD. I'M OPPOSED BECAUSE THE SETBACK RESTRICTION ON THIS PARTICULAR BUILDING IS NOT REFLECTED BY THE PD TO BE 25 FEET. THE PD ALLOWS THE, THE SIDE SETBACK ON THE BUILDINGS TO BE FIVE FEET. AND SO THE INTENT WAS THAT THESE BUILDINGS WOULD BE 25 FEET FROM THE, FROM THE NEIGHBOR'S PROPERTIES AND THE ADJOINING NEIGHBORHOOD. BUT BECAUSE THIS PARTICULAR BUILDING IS, IS SITUATED SO THAT THE SIDE OF THAT BUILDING A BUST, THE PROPERTY RATHER THAN THE BACK OF THAT BUILDING ABUTTING THE PROPERTY, THE RESTRICTION ON THAT PARTICULAR BUILDING IS ONLY FIVE FEET FROM THE REAR OF THE, OF THE BUILDING OR THE SIDE OF THE BUILDING. THE, THE, THE RESTRICTION ON REFLECTED IN THE PD FOR THE REAR OF THE BUILDINGS IS 25 FEET. OKAY. BECAUSE THIS ONE BUILDING, BUILDING B, IT'S BUILDING B LOT SEVEN BECAUSE THAT BUILDING THE SIDE OF IT ABUTS THE NEIGHBOR'S PROPERTIES. THE, THE RESTRICTION ON THAT PARTICULAR BUILDING IS ONLY FIVE FEET. OKAY. JUST BECAUSE OF THE WAY IT'S SITUATED, BECAUSE IT'S THE SIDE AND NOT THE REAR OF THAT BUILDING FACING OR THAT'S ABUTTING THE NEIGHBOR'S PROPERTY.
