I'M VERY PROUD THAT I WAS JUST TALKING TO DR.

WE BELIEVE WE'RE APPROACHING OUR 20TH YEAR OF HAVING DONE THIS REPORT, PRODUCED IT, AND PRESENTED IT TO THE PUBLIC, UH, IT'S STATE LAW NOW.

BUT IN THE FIRST FIVE OR SIX YEARS THAT IT WAS DONE HERE, UH, CEDAR HILL WAS A PIONEER IN THE STATE FOR BEING ABLE TO COLLECT THIS DATA AND TO BE ABLE TO HAVE THE CONVERSATIONS OF PUTTING IT OUT THERE FOR THE PUBLIC.

AND SO WE'RE VERY PROUD OF THE FACT THAT WE PIONEERED THIS AND THAT, UH, WE'RE STILL DOING THAT.

AND THEN UNDER, UH, WITH CHIEF REYES'S LEADERSHIP, AS YOU KNOW, THERE ARE A NUMBER OF OTHER REPORTS THAT NOW COME OUT ANNUALLY THAT THEN HELP TO UNDERSCORE, UH, AND SUPPORT AND REINFORCE THE RELATIONSHIP THAT THE PEOPLE WHO SERVE HAVE WITH THE PEOPLE WHO ARE SERVED.

SO WE'RE VERY PROUD OF THAT AND LOOK FORWARD TO THE, HIS PRESENTATION IN FRONT OF YOU TODAY.

I DON'T HAVE TO TELL YOU THAT THIS HAS BEEN ON THE COUNCIL'S PRIORITY AND BIG ROCK LISTS FOR SEVERAL STRATEGIC PLANS.

UM, THE STAFF HAS, UH, WORKED ON IT AND WORKED ON IT.

AND IT TOOK OUR NEW PLANNING DIRECTOR, UH, UH, CHASSIS VINCENT TO GET HERE, LEARNED THE PLACE, AND TO BE ABLE TO REALLY PUT THE CONCENTRATION ON IT AFTER THE COUNCIL REINFORCED, UM, THE OPPORTUNITY TO WANT TO HAVE IT, BUT ALSO THE FACT THAT IT WANTED A PILOT PROGRAM THAT WE COULD START PRETTY SOON.

SO THE PROGRAM THAT SHE WILL BE BRINGING YOU TODAY INCLUDES THE INPUT THAT YOU'VE HAD, AS WELL AS THE INPUT FROM PLANNING, ZONING, COMMISSION, UH, THE COMMUNITY THAT DO FOOD TRUCKS, AND THEN ALL OF THE INPUT WE'VE RECEIVED FROM THE PUBLIC OVER THE YEARS.

SO THIS IS A GREAT DAY.

SO ALL TRAFFIC STOPS, WHICH OCCURRED IN, UH, 2023.

POLICE OFFICERS IN CEDAR HILL MUST COLLECT CERTAIN INFORMATION AS REQUIRED BY LAW.

UH, THAT LAW HAS BEEN IN PLACE SINCE, UH, 2001, AND PART OF THE LAW NOW REQUIRES THE ANNUAL REPORTING OF THE DATA ANALYSIS THAT IS PERFORMED.

AND THAT'S WHAT WE'LL BE TALKING ABOUT TONIGHT.

SO THE FIRST THING THAT, THAT WE DO WHEN WE WORK WITH AN AGENCY EACH YEAR IS WE GET ALL OF THEIR INFORMATION TO MAKE SURE THEY'RE COMPLIANT WITH THE RACIAL PROFILING LAW IN THIS STATE.

AND SO CERTAIN THINGS ARE REQUIRED BY LAW.

FOR EXAMPLE, POLICY PROHIBITING RO, RACIAL PROFILING.

THERE MUST BE A RACIAL PROFILING COMPLAINT PROCESS, PUBLIC EDUCATION ABOUT THE COMPLAINT PROCESS.

AND WE VERIFY THAT THAT IS ALL IN PLACE.

THERE MUST BE OFFICER TRAINING AND EDUCATION.

AND THEN REALLY WHAT WE SPEND MOST OF OUR TIME ON IS ON THE DATA ANALYSIS PART.

AND WHEN IT COMES TO THE DATA ANALYSIS, THE ANALYSIS IS PERFORMED PRESCRIBED BY LAW.

SO IN OUR TEXAS CODE OF CRIMINAL PROCEDURE, IT STATES YOU GET THE DATA, AND THIS IS THE ANALYSIS THAT IS PERFORMED ON IT.

SO EACH ONE OF THESE SLIDES KIND OF GOES THROUGH THAT, THE COMPARATIVE ANALYSIS THAT'S PERFORMED, UM, EACH YEAR.

THE FIRST ONE BASICALLY IS YOUR STOPS BROKEN DOWN BY RACE ETHNICITY, AND THAT'S WHAT'S ON THIS SLIDE.

AND SO IN 2023, YOU HAD JUST SHY OF 10,000, UH, 350 TRAFFIC STOPS.

AND THEN THAT IS BROKEN DOWN BY, UH, RACE AND ETHNICITY.

UM, MOTORISTS THAT WERE MOST LIKELY TO BE STOPPED IN, UH, CEDAR HILL IN 2023 WERE BLACK MOTORISTS, THEN HISPANIC MOTORISTS, WHITE MOTORISTS, ASIAN MOTORISTS, AND THEN, UH, NATIVE AMERICAN, UH, MOTORISTS.

WE THEN COMPARE THAT TO SOME BENCHMARK.

AND THE BENCHMARKS, UH, THE CITY, THE POPULATION CENSUS BENCHMARKS ARE PRESCRIBED BY T COLE.

SO THE TEXAS COMMISSION ON LAW ENFORCEMENT OTHERWISE SHORTENED FOR T COLE IS OUR LICENSING BODY FOR POLICE OFFICERS IN THIS STATE.

AND KIND OF THE TRAINING STANDARDS BODY, WELL, THEY'RE TASKED BY LAW TO IMPLEMENT THE RACIAL PROFILING LAW.

AND SO THEY, THEY HAVE COME OUT WITH A DIRECTIVE THAT SAYS, TAKE THE DATA THAT YOU HAVE BROKEN DOWN BY RACE ETHNICITY AND COMPARE IT TO YOUR POPULATION.

AND SO FOR THE CEDAR CITY OF CEDAR HILL, WE USE THREE POPULATION METRICS.

WE USE, UH, THE CITY, THE COUNTY, AND THEN THE REGION, WHICH IS, UH, 16 COUNTY AREA, UH, CHIEF REYES LAST YEAR.

AND IT IS ALSO INCLUDED THIS YEAR.

UH, SO FOR THE SECOND YEAR WE HAVE CITY DRIVER'S LICENSE.

UH, YOU'RE IN A UNIQUE POSITION THAT YOU HAVE A UNIQUE ZIP CODE FOR THE CITY OF CEDAR HILLS.

SO WE HAVE THE CITY DRIVER'S LICENSE IN THERE AS WELL.

AND BASICALLY WE COMPARE THAT TO THEN THE PERCENTAGE OF STOPS BROKEN DOWN, UM, BY RACE ETHNICITY.

BUT WE HAVE FOUR BENCHMARKS THERE.

UH, THERE'S PROBLEMS WITH ANY BENCHMARK THAT WE UTILIZE.

AND SO ONE OF THE PROBLEMS THAT WE, WE HAVE IS THAT BASICALLY THE BENCHMARKS DON'T MEASURE THE DRIVING POPULATION, WHICH IS WHAT WE WANT.

WE KNOW WHO WAS STOPPED AND THE RACE ETHNICITY OF THE PE PEOPLE THAT WERE STOPPED.

WE JUST DON'T KNOW WHO DRIVES INSIDE, UH, THE CITY OF CEDAR HILL.

AND EVEN WITH LIKE THE DRIVER'S LICENSE ONE, WHICH, UM, SEEMS LIKE A BETTER BENCHMARK THAN THE CENSUS.

UM, IT STILL DOESN'T HAVE ANYBODY THAT DOES LIVE INSIDE OF THE CV OF, UH, CEDAR HILL IN THAT DATA.

ALSO DOESN'T INCLUDE, UM, ANYTHING REGARDING FREQUENCY IN WHICH PEOPLE DRIVE THEIR DRIVING BEHAVIOR, THOSE TYPES OF FACTORS THAT IMPACT, UM, A PER A PERSON'S PROPENSITY TO BE STOPPED.

SO THAT'S ONE OF THE PROBLEMS WITH THE DATA AS PRESENTED ON TRAFFIC STOPS.

THE OTHER PROBLEM IS, IS THAT OFFICERS GENERALLY DO NOT KNOW THE RACE OR ETHNICITY OF THE PERSON IN WHICH THEY'RE STOPPING.

AND SO THAT DATA HAS BEEN COLLECTED IN THIS STATE FOR EVERY TRAFFIC STOP SINCE 20, UH, 2009 AND STATEWIDE AVERAGE LAST YEAR, WE'RE LOOKING AT ABOUT 5 MILLION TRAFFIC STOPS ACROSS ABOUT 1200 DIFFERENT AGENCIES, OBVIOUSLY EXCLUDING, UM, DPS 'CAUSE THEY WOULD BE RESPONSIBLE FOR, UM, TWO THIRDS OF THOSE STOPS.

SO EXCLUDING THEM, THE PERCENTAGE IS 2%.

SO 2% OF THE TIME IN THIS STATE DOES THE OFFICER KNOW THE RACE ETHNICITY PRIOR STOP.

CITY, CITY OF CEDAR HILL FALLS RIGHT IN LINE WITH THIS.

IT'S SLIGHTLY UNDER, UH, 1% OF THE TIME.

THAT'S PROBLEMATIC FOR WHAT WE

JUST, UH, SHOWED REGARDING STOP DATA, BECAUSE RACE PROFILING IS DEFINED AS A LAW ENFORCEMENT ACTION BASED UPON A PERSON'S RACE.

SO IN CITATIONS, 43% OF THE WHITE MOTORISTS RECEIVED A CITATION.

43% OF THE BLACK MOTORISTS RECEIVED A CITATION, 54% OF HISPANICS AND 57% OF ASIAN MOTORISTS.

YEAH, THERE'S DIFFERENCES, THERE WILL BE DIFFERENCES.

BUT WE LOOK FOR, UH, GENERAL CONSISTENCY IN, UM, BEHAVIOR.

USUALLY THE ONE THAT HAS THE, THE, THE DISPARITY IN IT IS ARRESTS AS AS IT DOES HERE.

BUT ONE OF THE NICE THINGS IS WITH THE LAW THAT WE HAVE NOW AND THE DATA WE COLLECT, WE CAN UNDERSTAND WHY PEOPLE ARE ARRESTED.

SO BEHAVIORS, CEDAR, UH, HILL OFFICERS ARE IN LINE WITH OFFICERS THROUGHOUT THE STATE REGARDING THE FREQUENCY IN WHICH THEY, UH, SEARCH, UH, MOTORISTS.

SAME KIND OF ASSESSMENT IS DONE AS FAR AS COLUMN PERCENTAGES ARE DONE.

AND SO BASICALLY, UH, 3.2% OF THE WHITE MOTORISTS WERE SEARCHED.

WE LOOK AT KIND OF WHY ARE PEOPLE BEING, UH, SEARCHED AND CAN ANY DISPARITY IN THE SEARCHES BE EXPLAINED BY, UH, THOSE DIFFERENCES? TWO PRIMARY REASONS, UH, FOR SEARCH SEARCHES, INCIDENT, UM, SEARCHES BASED UPON PROBABLE CAUSE.

SO THE OFFICER HAS A PROBABLE CAUSE TO BELIEVE THERE'S EVIDENCE OF A CRIME INSIDE OF THAT VEHICLE, AND THEREFORE CAN SEARCH THAT VEHICLE INTO THE LAW.

AND I BELIEVE THAT A LOT OF THAT HAS TO DO WITH THE INABILITY TO OBTAIN A DRIVER'S LICENSE.

UM, AND SO I HAVE ASKED THEM TO RESEARCH, UH, TO CREATING THAT PATHWAY.

SO THESE ARE US CITIZENS? NO.

OH, THEY'RE NOT US CITIZENS.

SO, UH, AGAIN, THIS SLIDE SAYS 2022, BUT DISCUSSIONS RELATED TO FOOD TRUCKS ACTUALLY GO FURTHER BACK THAN THAT.

UM, BUT THERE WAS A REVIVED CONVERSATION, UH, RELATED TO THEM IN 2022 WHEN THE PLANNING STAFF PRESENTED TO THE PLANNING ZONING COMMISSION INFORMATION RELATED TO A POTENTIAL FOOD TRUCK ORDINANCE.

UM, PRESENTED THAT SAME INFORMATION TO THE CITY COUNCIL.

AND CITY COUNCIL, UM, WANTED TO, UH, PROCEED WITH, UH, DEVELOPING A, UH, AN ORDINANCE.

AND AT THAT TIME, UH, PLANNING STAFF MET WITH SOME FOOD TRUCK OPERATORS TO GAIN SOME ADDITIONAL INFORMATION, EVEN HAD A POPUP FOOD TRUCK, UH, DEMO AT THE HOLIDAY ON THE HILL IN 2022.

UH, AND THEN, UM, THE PROCESS, UM, PAUSE AS WE HAD SOME TRANSITION, UM, FOR THE STAFF.

UM, BUT WE ARE, UM, BACK INTO IT TODAY.

UM, AND SO, UH, FOR THE PREVIOUS COUNCIL CONSIDERATION, SO SOME OF THESE THINGS WERE THE, THE, UH, ITEMS THAT COUNCIL BROUGHT UP IN THE INITIAL DISCUSSIONS.

UM, THERE WAS A LOT OF DISCUSSION AT THAT TIME ABOUT, UM, CREATING FOOD TRUCK PARKS, WHICH IS MORE OF A PERMANENT LAND USE THAT, YOU KNOW, ONE LOCATION WHERE FOOD TRUCKS CAN LOCATE.

THAT WAS, UH, DISCUSSED.

THERE WAS A, A DISCUSSION REGA REGARDING, YOU KNOW, HOW SALES TAXES COLLECTED AND WHAT THE IMPACT WOULD BE TO BRICK AND MORTAR RESTAURANTS.

ALL REALLY GOOD QUESTIONS AND REALLY INFORMED, UM, THE ADDITIONAL

RESEARCH THAT STAFF CONDUCTED AS IT RELATES TO, UH, FOOD TRUCKS AND HOW OTHER CITIES, UH, OR OTHER CITY ORDINANCES, UH, ARE STRUCTURED TO ALLOW FOR THEM.

SO, UM, AS, UH, MR. PORTER MENTIONED, UM, YOU ALL HAD REVIVED THIS CONVERSATION DURING YOUR COUNCIL RETREAT AND YOUR COUNCIL RETREAT FOLLOW UP.

AND THE DISCUSSION MOVED TO THE, THE, UH, OPPORTUNITY TO INTRODUCE A PILOT PROGRAM ORDINANCE AND THE BENEFITS OF THE PILOT PROGRAM.

IT REALLY DOES ALLOW FOR A FASTER PATH TO IMPLEMENTATION.

UM, IT ALSO ALLOWS FOR US TO, UM, GATHER INFORMATION, UM, BECAUSE THAT'S SOMETHING WE JUST REALLY DON'T KNOW.

WE, WE'VE, WE'VE HEARD THAT THIS IS SOMETHING THE COMMUNITY WANTS.

WE'VE HEARD FROM FOOD TRUCK OPERATORS, BUT WE NEED TO HAVE A FULL UNDERSTANDING OF, UM, YOU KNOW, HOW, HOW TO BEST, UM, ADDRESS THE, UH, THE ISSUE.

AND SO THE PILOT PROGRAM GIVES US THAT OPPORTUNITY.

UM, SO WE DID PROPOSE THE PILOT PROGRAM ORDINANCE DURING YOUR FOLLOW-UP RETREAT.

AND SO BECAUSE WE HAVE AN EXISTING FOOD STARTS FOOD SERVICE ESTABLISHMENTS ORDINANCE, UH, WE'RE ABLE TO MODIFY OR AMEND THAT ORDINANCE TO ADDRESS THE PILOT PROGRAM.

SO, UM, AT THE COUNCIL RETREAT, A FOLLOW UP MEETING, UM, COUNCIL ASKED FOR ADDITIONAL, UH, FEEDBACK FROM THE FOOD TRUCK OPERATORS.

SO WE HELD A MEETING IN FEBRUARY.

WE EXTENDED THAT INVITATION, UM, OUT, WE ALSO EXTENDED THE INVITATION TO SOME MAJOR RETAIL PROPERTY OWNERS IN THE CITY.

UH, SO WE HAD ABOUT SIX FOOD TRUCK OPERATORS ATTEND AS WELL AS A REPRESENTATIVE FROM HILLSIDE VILLAGE.

AND THAT WAS REALLY INFORMATIVE BECAUSE, UH, AS YOU SEE, AS WE TALK ABOUT THE, THE, THE, UM, ASPECTS OF THE ORDINANCE, UM, PRIVATE PROPERTY OWNERSHIP IS REALLY, THEY PLAY AN INTEGRAL ROLE IN HOW WE'RE WE'VE CRAFTED THE ORDINANCE.

AND SO, UM, WE GOT A LOT OF FEEDBACK DURING THAT MEETING.

UM, THE FIRST ONE WAS MAKE THE PROCESS SIMPLE.

THEY, UH, DIDN'T WANT TO HAVE TO, YOU KNOW, OVERLY BURDENSOME REGULATIONS OR PROCESS.

UM, THEN ALSO THERE'S A LOT OF DISCUSSION ABOUT THE CONSIDERATION OF THE LONG-TERM FOOD TRUCK PARK IDEA.

SO THERE'S CERTAINLY, UM, THAT'S STILL, UH, A CONSIDERATION.

THAT'S DEFINITELY SOMETHING THAT WE WOULD STILL, UH, CONTINUE TO LOOK AT.

BUT I THINK THIS, UH, PILOT PROGRAM ORDINANCE WILL ACTUALLY EVEN INFORM US WHERE'S THE BEST PLACE FOR THAT TYPE OF USE, BECAUSE WE CAN MAKE ASSUMPTIONS ABOUT WHERE WE THINK IT MIGHT BE APPROPRIATE.

BUT I THINK THE DATA THAT WE GATHER FROM THIS PILOT PROGRAM WILL REALLY BEAR OUT, WELL, MAYBE IT'S ACTUALLY IN THIS PARTICULAR AREA VERSUS ANOTHER.

UH, AND THEN THE OTHER FEEDBACK WAS TO NOT DUPLICATE THE DALLAS COUNTY HEALTH REQUIREMENTS.

SO, UM, THE, UH, FOOD TRUCKS THAT OPERATE, THAT'S, THAT'S, THAT'S PRETTY DIRECT , WELL, PARTICULARLY BECAUSE A LEGISLATION CHANGED, UH, RECENTLY UNDER THE LAST LEGISLATIVE SESSION.

AND SO, UM, IF YOU ARE A FOOD TRUCK, UH, OPERATOR AND YOU OPERATE WITHIN DALLAS OR TARRANT COUNTY, UH, THEN YOU ONLY HAVE TO GET YOUR HEALTH PERMANENT INSPECTIONS THROUGH DALLAS COUNTY.

UM, AND SO, UM, A LOT OF IN DALLAS COUNTY'S, UM, PROCESSES IS, UH, INTENSE AND, AND AS, AS IT SHOULD BE.

UM, BUT CERTAINLY THERE WAS NO NEED TO DUPLICATE THOSE HEALTH REQUIREMENTS BECAUSE ALL OF THAT IS ACTUALLY MANDATED BY DALLAS COUNTY.

SO IN DEVELOPING THE FOOD TRUCK PILOT PROGRAM ORDINANCE, WE WANTED TO MAKE SURE THAT THE ORDINANCE ITSELF WAS ALL ENCOMPASSING SO THAT WE LITERALLY WOULD JUST LOOK AT THAT SECTION OF THE CODE.

AND IT INCLUDES EVERYTHING FROM DEFINITIONS, THE PERMITTED LOCATIONS, IT SETS THE REQUIREMENTS AND EVEN THE APPROVAL PROCESS.

SO THAT'S JUST ONE, UH, ORDINANCE THAT EFFECTIVELY, UM, OUTLINES EVERYTHING REQUIRED FOR THE, UH, FOOD TRUCKS.

SO WE WANTED TO CLARIFY A COUPLE OF THINGS BECAUSE WE, FOOD TRUCKS, UM, TYPICALLY ARE THESE, RIGHT? SO THEY'RE TYPICALLY, YOU KNOW, IN A FOOD TRUCK FORMAT, BUT THEY CAN ALSO, UM, BE A FOOD TRAILER.

SO THEY'RE NOT MOVED BY THEMSELVES.

THEY HAVE TO BE HOOKED UP TO, UM, TO A MOBILE, UM, UNIT.

SO, UH, WE'VE MADE THE DISTINCTION IN THE ORDINANCE, UM, TO DEFINE A MOBILE FOOD VENDING UNIT AS EITHER A FOOD TRAILER OR THE FOOD TRUCK.

UM, IN THE, UM, DISCUSSIONS THAT WE'VE HAD WITH COUNCIL, AS WELL AS, UM, SOME OF THE PROPERTY OWNERS, UH, WE RECOGNIZE THAT WE WANT TO, UH, ALLOW FOR THE FOOD TRUCKS TO BE LOCATED ON PRIVATE PROPERTY.

UM, IT MUST BE IN LOCAL RETAIL, INDUSTRIAL INDUSTRIAL PARK UPTOWN OVERLAY, WHICH INCLUDES THE OLD TOWN SQUARE AND, AND OLD TOWN CORRIDOR DOWNTOWN DISTRICTS.

UM, AND ALONG OUR COMMERCIAL CORRIDORS.

SO HIGHWAY 67, BELTLINE 1382 PLEASANT RUN.

UM, CEDAR HILL IS, UM, REALLY STRUCTURED VERY WELL FOR US TO ALIGN IT THIS WAY BECAUSE OUR COMMERCIAL AREAS JUST SO HAPPEN TO BE ON THOSE CORRIDORS.

SO WE DO HAVE A FEW POCKETS OF, UH, LOCAL RETAIL ZONE PROPERTY THAT ARE KIND OF OUTLIERS.

UM, BUT THOSE ARE, UM, THOSE WOULD NOT BE ELIGIBLE.

IT'S THIS, THESE, UH, COMMERCIAL CORRIDORS THAT WE HAVE.

UM, THE PRIVATE PROPERTY, UH, MUST BE DEVELOPED AND OCCUPIED WITH A

BUSINESS THAT HAS A CURRENT CERTIFICATE OF OCCUPANCY.

SO THE INTENT OF THAT IS TO NOT ALLOW FOR FOOD TRUCKS TO LOCATE ON, UM, UNDEVELOPED JUST A, A VACANT LOT.

UM, THEY ACTUALLY HAVE TO BE ON A DEVELOPED PROPERTY.

UM, THAT'S PRIMARILY BECAUSE WE'LL GO THROUGH SOME OF THE REQUIREMENTS OF THE, UH, ORDINANCE, UH, FOR THE REGISTRATION.

BUT WE DO REQUIRE, WE WILL REQUIRE, UH, PRIVATE PROPERTY OWNER AUTHORIZATION.

SO THAT WILL ALLOW FOR US TO ENSURE THAT THE PRIVATE PROPERTY OWNER HAS SAID THEY CAN BE THERE.

UM, AND THEN, UH, IN TERMS OF BEING, UH, UH, ABLE TO LOCATE ON PUBLIC PROPERTY, THAT WOULD STILL BE THROUGH THE SPECIAL EVENTS THAT WE ALREADY HAVE.

SO THAT PROCESS WOULD NOT CHANGE FOR ANY PUBLIC, UH, PROPERTY, UM, IN TERMS OF REQUIREMENTS.

SO THEY WILL STILL HAVE TO GET THEIR HEALTH INSPECTIONS AND THEIR PERMIT HEALTH PERMIT FROM DALLAS COUNTY.

UM, OUR, THE FIRE INSPECTIONS AND THE FIRE PERMIT FROM CEDAR HILL, UM, DALLAS COUNTY ACTUALLY REQUIRES THAT AS PART OF THEIR HEALTH PERMIT.

SO THEY HAVE TO HAVE THEIR INSPECTION FROM THE FIRE MARSHAL, UH, AND THEIR PERMIT BEFORE THEY ACTUALLY GET THEIR DALLAS COUNTY, UH, HEALTH PERMIT.

UM, AND THEN REGISTRATION FOR THE MOBILE FOOD VENDING UNIT, UH, FROM CEDAR HILL.

THERE ARE MORE REGISTRATION REQUIREMENTS.

I DIDN'T PUT THEM FULLY ON THE SLIDE, BUT THEY'RE EMBEDDED, UH, IN THE ORDINANCE FOR YOUR CONSIDERATION.

UM, SO GOING THROUGH BRIEFLY SOME OF THE REQUIREMENTS THAT WOULD APPLY, UM, OF COURSE WE MENTIONED THAT IT WOULD HAVE TO BE ON PRIVATE PROPERTY.

UH, THEY WILL HAVE TO HAVE SOME GARBAGE FACILITIES THAT THEY WOULD BE ABLE TO, THAT'S FULLY CONTAINED AND BE ABLE TO BE REMOVED AT THE END OF THE OPERATIONS.

UM, THEIR MOBILE FOOD VENDOR, UM, UH, THE MOBILE FOOD VENDOR SHOW DISPLAY AT ALL TIMES THEIR, THEIR SALES TAX, UH, CERTIFICATE.

UM, THEY HAVE TO BE SEPARATED FROM EXISTING BUILDINGS AND OTHER MOBILE, UH, VENDING UNITS BY MINIMUM OF 10 FEET.

THAT'S PER FIRE MARSHAL.

UM, THEY CAN'T SET UP IN ANY FIRE LANES AND CAN'T OCCUPY, UH, MORE THAN 10% OF THE REQUIRED PARKING SPACES THAT ARE NECESSARY FOR THE EXISTING BUSINESS.

SO WE WANNA USE THIS AS A BENEFIT TO THOSE EXISTING BUSINESSES, NOT A DETERRENT.

UM, FOR THEM TO BE ABLE TO, TO IMPACT THEIR, THEIR BUSINESSES NE NEGATIVELY.

UM, THEY HAVE TO BE ON A, AN IMPROVED SURFACE.

UM, THEY CAN'T EXTEND THEIR AREA, UH, FOR SELLING, STORING OR DISPLAYING CAPACITY.

SO PRETTY MUCH FROM THE TRUCK ITSELF, UM, WE'VE LIMITED THE HOURS FROM 8:00 AM TO 10:00 PM THAT'S A COMBINATION OF LIGHTING, A COMBINATION OF ENFORCEMENT, A COMBINATION OF BEING ABLE TO, UM, ALIGN WITH, WITH SOME OF THE OPERATING HOURS OF SOME OF THE BUSINESSES UNLESS IT'S AUTHORIZED WITH A SPECIAL EVENT PERMIT.

SO AGAIN, THIS IS ADDRESSING, YOU KNOW, A FOOD TRUCK THAT WANTS TO GO ON A SATURDAY TO HILLSIDE VILLAGE WITH HILLSIDE VILLAGE, UM, AUTHORIZATION NOT ASSOCIATED WITH A GRAND OPENING OR, OR SOMETHING OF THAT NATURE.

THOSE SPECIAL EVENT PERMITS AND THINGS OF THAT NATURE WOULD STILL APPLY.

UH, WE WOULD ALLOW FOR TWO, UH, SANDWICH BOARD SIGNS THAT THEY HAVE TO HAVE, BUT NO OTHER SIGNAGE.

IT MUST BE AFFIXED TO THE TRUCK.

UM, WE DID ALSO INCLUDE THAT THEY MUST MEET THIS PERFORMANCE STANDARDS OF THE ZONING ORDINANCE, WHICH THAT'S NOISE, UM, UM, ODOR, UM, NOXIOUS, UM, UH, THE NOXIOUS STANDARDS.

SO THOSE ARE ALL, UH, THINGS THAT THEY MUST COMPLY WITH.

UM, PRO PROHIBITION ON DRIVE-THROUGH SERVICE AND ALCOHOL CELLS.

UM, AND THEN, UM, ALSO WE HAVE REVOCATION, UH, PROCEDURES IN THE ORDINANCE AS WELL FOR REPEAT VIOLATIONS.

THEN CERTAINLY THEY WOULD NOT, UM, THEIR AUTHORIZATION WOULD BE REMOVED AND THEY WOULDN'T BE ABLE TO, UH, REGISTER AGAIN FOR SIX MONTHS IS HOW THE ORDINANCE IS CURRENTLY CRAFTED.

SO THERE'S A, THERE'S A MECHANISM THERE FOR US TO REGULATE THAT.

UM, SO AGAIN, WE'VE UM, BEEN WORKING ON THIS FOR A WHILE, BUT FOR THIS YEAR, UM, WE'VE, WITH THE DRAFTING OF THE ORDINANCE, THE PILOT PROGRAM REGULATIONS HAVE BEEN DRAFTED AS AN AMENDMENT TO CHAPTER EIGHT OF THE FOOD AND FOOD SERVICE CODE OF ORDINANCES.

UM, IT'S COMING BEFORE YOU TONIGHT ON THE CONSENTS AGENDA, UH, AS, UH, AN ORDINANCE ADOPTION.

UH, AND, UH, WE'VE SET AN EFFECTIVE DATE OF JUNE 1ST.

UH, THAT GIVES US A LITTLE BIT OF TIME TO, NOT A LOT OF TIME, BUT A LITTLE BIT OF TIME, UM, TO MARCH, UPDATE OUR WEBSITE, CREATE THE AUTHORIZATION FORMS, UH, TRAIN STAFF AND, AND GET PREPARED FOR WHAT WE HOPE, UH, IS A SUCCESSFUL, SUCCESSFUL, UH, PILOT PROGRAM.
