THIS WILL BE PRESENTED BY VERY OWN COUNCILWOMAN DANIELS AND, UH, MS. TIA TIA BREWER.

YES, YOU WILL PLEASE COME UP AND RECEIVE IT.

I THINK YOU HAVE SOME BOARD MEMBERS HERE WITH YOU PROCLAMATION.

WHEREAS HAVING A NEIGHBOR YOU CAN COUNT ON NO MATTER WHAT LIFE THROWS YOUR WAY, IS SOMETHING THAT SHOULD NEVER BE TAKEN FOR GRANTED.

AND WHEREAS NATIONAL GOOD NEIGHBOR DAY BEGAN IN THE EARLY 1970S WHEN BECKY MATHSON, A RESIDENT OF LAKESIDE MONTANA, DECIDED THAT NEIGHBORS ACROSS THE COUNTRY NEEDED TO GET TO KNOW ONE ANOTHER ON A MORE INTIMATE LEVEL THAN A QUICK WAVE OR SIMPLE HELLER.

AND WHEREAS IN 2003, THE UNITED STATES SENATE FINALLY PASSED A RESOLUTION DECLARING SEPTEMBER THE 28TH AS THE OFFICIAL DAY TO CELEBRATE AND HONOR YOUR NEIGHBORS.

AND WHEREAS NEIGHBORHOODS U S A ENCOURAGES ALL THOSE WHO ARE COMMITTED TO BUILDING STRONGER COMMUNITIES THROUGHOUT THE WORLD, TO TAKE PART IN NATIONAL GOOD NEIGHBOR DAY.

NOW, THEREFORE, I, STEPHEN MASON, MAYOR OF CEDAR HILL DO HEREBY PROCLAIM SEPTEMBER THE 28TH, 2023 AS NATIONAL GOOD NEIGHBOR DAY IN THE CITY OF CITY HILL, TEXAS.

THE AGENDA IS PRESENTED PROCLAMATION, RECOGNIZING THE WEEK OF OCTOBER 8TH THROUGH THE 14TH 2023 AS FIRE PREVENTION WEEK IN CEDAR HILL.

THIS WILL BE PRESENTED BY COUNCIL MEMBER GLOVER.

YOU INVITED A FEW FRIENDS.

I I SEE WE HAVE SOME FRIENDS.

YOU KNOW, SOMETIMES YOU SITTING UP HERE BY YOURSELF AND YOU CAN HEAR YOURSELF THINK.

AND NOW WE HAVE OUR FIRE FAMILY WITH US.

SO IT'S AN HONOR AND PLEASURE TO BE HERE THIS EVENING.

I HAVE A PRO PROCLAMATION FROM THE OFFICE OF THE MAYOR, WHEREAS THE CITY OF CEDAR HILL IS COMMITTED TO ENSURING THE SAFETY AND SECURITY OF ALL THOSE LIVING IN AND VISITING OUR CITY.

AND WHEREAS FIRE IS A SERIOUS PUBLIC SAFETY CONCERN, BOTH LOCALLY AND NATIONALLY AND HOMES ARE THE LOCATIONS WHERE PEOPLE ARE AT THE GREATEST RISK FROM FIRE HOME FIRES KILLED MORE THAN 2,800 PEOPLE IN THE UNITED STATES IN 2021.

ACCORDING TO THE NATIONAL FIRE PROTECTION, N F P A AND FIRE DEPARTMENTS IN THE UNITED STATES RESPONDED TO 338,000 HOME FIRES.

AND WHEREAS COOKING IS THE LEADING CAUSE OF HOME FIRES IN THE UNITED STATES AND FIRE DEPARTMENTS RESPONDED TO MORE THAN 164,400 ANNUALLY BETWEEN 2016 AND 2022 OUTTA EVERY HOME.

FIRES START IN THE KITCHEN WHERE 31% OF THESE FIRES RESULTING FROM UNATTENDED COOKING.

AND WHEREAS CITY CEDAR HILL RESIDENTS SHOULD TURN POT HANDLES TOWARDS THE BACK OF THE STOVE, ALWAYS KEEP THE A LID NEARBY WHEN COOKING, KEEP A THREE FOOT KID FRIENDLY FREE ZONE AROUND THE ZONE, AROUND THE STOVE OVEN AND OTHER THINGS THAT COULD GET HOT.

WATCH WHAT THEY HEAT AND SET A TIMER TO REMIND THEM THAT THEY THEY ARE COOKING.

AND WHEREAS RESIDENTS WHO WHO HAVE PLANNED AND PRACTICED A HOME FIRE ESCAPE PLAN ARE MORE PREPARED AND WILL THEREFORE BE MORE LIKELY TO SURVIVE A FIRE WORKING SMOKE ALARMS CUT THE WRIST OF DYING AND REPORTED HOME FIRES ALMOST IN HALF.

AND WHEREAS CEDAR HILL FIRST RESPONDERS ARE DEDICATED TO REDUCING THE OCCURRENCE OF HOME FIRES AND HOME FIRE INJURIES THROUGH PREVENTION AND PROTECTION EDUCATION.

AND WHEREAS CEDAR HILL RESIDENTS ARE RESPONSIVE TO PUBLIC EDUCATION, ME MEASURES, AND ARE ABLE TO TAKE PERSONAL STEPS TO INCREASE THEIR SAFETY FROM FIRE, ESPECIALLY IN THEIR HOMES.

AND WHEREAS THE 2023 FIRE PREVENTION WEEK THEME IS COOKING SAFETY STARTS WITH YOU PAY ATTENTION TO FIRE TO FIRE PREVENTION.

FIRE PREVENTION EFFECTIVELY SERVES TO REMIND US TO STAY ALERT AND USE CAUTION WHEN COOKING TO REDUCE THE RISK OF FIRE, OF KITCHEN FIRES.

THEREFORE, I, STEPHEN MASON, MAYOR OF THE CITY OF CEDAR HERE DO HEREBY PROCLAIM OCTOBER 8TH THROUGH 14TH 2023 AS FIRE PREVENTION WEEK THROUGHOUT THIS CITY.

AND I URGE ALL PEOPLE OF CEDAR HILL TO CHECK THEIR KITCHENS FOR FIRE HAZARDS AND USE SAFE COOKING PRACTICES DURING FIRE PREVENTION WEEK 2023 AND TO SUPPORT THE MINDY PUBLIC SAFETY ACTIVITIES AND EFFORTS OF THE CEDAR OF THE CEDAR HILL FIRE DEPARTMENT AND EMERGENCY SERVICES

AGENDA IS A PROCLAMATION, UH, DESIGNATED THE MONTH OF OCTOBER, 2023 AS NATIONAL COMMUNITY PLANNING MONTH IN CEDAR HILL.

THIS WILL BE PRESENTED BY MAYOR FOR TIM SIMS. THANK YOU, MAYOR.

IT'S AN ABSOLUTE PLEASURE FOR ME TO, UM, TO BE, TO READ THIS PROCLAMATION.

AND THE REASON WHY I SAY THAT IS THERE ARE A LOT OF THINGS THAT WE AS A CITY ENJOY TODAY, BUT PEOPLE MAY NOT REALIZE.

BUT THE THINGS THAT WE'RE JOINED TODAY WERE PLANNED 20 YEARS AGO.

SO IT'S THE HALLMARK OF THIS CITY IS PLANNING AND IT'S MY PLEASURE TO READ THIS PROCLAMATION.

I'LL READ LOUD SO I CAN DROWN OUT SOME OF THE OTHER NOISE PROCLAMATION, OFFICE OF THE MAYOR.

WHEREAS CHANGE IS CONSTANT AND AFFECTS ALL CITIES, TOWNS, SUBURBS, COUNTIES, BOROUGHS, TOWNSHIPS, RURAL AREAS AND OTHER PLACES.

AND WHEREAS COMMUNITY PLANNING AND PLANS CAN HELP MANAGE THIS CHANGE IN A WAY THAT PROVIDES BETTER CHOICES FOR HOW PEOPLE WORK AND LIVE.

AND WHEREAS COMMUNITY PLANNING PROVIDES AN OPPORTUNITY FOR ALL RESIDENTS TO BE MEANINGFULLY INVOLVED IN MAKING CHOICES THAT DETERMINE THE FUTURE OF THEIR COMMUNITY.

AND WHEREAS THE FULL BENEFITS OF PLANNING REQUIRES PUBLIC OFFICIALS AND CITIZENS WHO UNDERSTAND SUPPORT, DEMAND EXCELLENCE IN PLANNING AND PLAN IMPLEMENTATION.

UM, THERE WAS A BIG CHEERLEADER, UH, WHO USED TO COME DOWN HERE TO OUR COUNCIL MEETING, UH, TO BE ABLE TO PROPOSE THAT WE NEED MORE SPACE, WE NEED MORE RESOURCES, AND, UH, THAT PERSON, YOU KNOW, WILL HOPEFULLY BE HONORED HERE TODAY.

SO I KNOW A LOT OF YOU ARE ARE HERE TO BE ABLE, UH, TO HEAR WHAT THIS RESOLUTION HAS TO SAY.

WHEREAS TINE HICKMAN HAS BEEN INSTRUMENTAL IN DEVELOPING AND SHAPING OF THE CEDAR HILL LIBRARY, SERVING AS THE FIRST LIBRARY DIRECTOR FROM 1959 UNTIL 1976 AND LATER SERVING AS THE DIRECTOR OF DALLAS COUNTY LIBRARY SYSTEM FROM 1976 UNTIL 1996.

AND RAF HICKMAN EPITOMIZED THE SPIRIT OF DEVOTED COMMUNITY INVOLVING BY I INVOLVEMENT BY SERVING THE CEDAR HILL LIBRARY IN DIFFERENT

CAPACITIES FOR MORE THAN 60 YEARS.

HER PASSION FOR LITERACY AND CREATING ACCESS TO KNOWLEDGE WAS A DRIVING FORCE THAT HELPED TO LAY THE FOUNDATION FOR WHAT OUR LIBRARY IS TODAY.

A DOOR TO DISCOVERY CHAFIN IS CREDITED FOR CREATING AND EMBODYING A UNIQUE AND LASTING VISION OF THE LIBRARY AS THE HEARTBEAT OF THE COMMUNITY.

AND THE CITY HAS WITNESSED A TRANSFORMATION AND EVOLUTION OF THAT VISION.

RAYMOND WOULD LIKE TO GET BACK INTO WOODWORKING, BUT LACKS SPACE IN HIS CURRENT LIVING SITUATION, ESPECIALLY ADAPTED HOME.

CUSTOM HOMES FOR OUR TROOPS HOME WILL PROVIDE RAYMOND WITH AMPLE WHEEL SPACE FOR HIS WHEELCHAIR, GIVING HIM ROOM TO HAVE HIS OWN WORKSHOP.

THEY ALSO DECIDED TO GET OUT AND, UH, WALK ON HIS PROPERTY AND TAKE PHOTOS OF THEMSELVES IN OTHER PARTS OF THE PROPERTY.

UH, SO MR. FULL SOUGHT A SECURITY FENCE IN FRONT OF HIS HOME.

UH, HE WAS TOLD THAT HE WAS NOT ENTITLED TO THE PERMIT BECAUSE OF A, THE CURRENT ORDINANCE AND, AND, UH, PLANT PUBLIC DEVELOPMENT PLAN THAT IS IN PLACE FOR THE LAKER AREA AND SOUGHT WAYS TO REMEDY THE PROBLEM.

HE WAS SUGGESTED TO HIM THAT HE FILE A PD AMENDMENT SPECIFIC TO HIS HOME, UH, AND THAT HE, THAT HE SEEK THE AMENDMENT, WHICH WAS HIS ONLY OPTION IN THIS WAY.

SO MR. FULLER FIRST, UH, HAD TO GET PERMISSION FROM THE P O A TO DO SO.

HE FILED HIS REQUEST FOR HIS FENCE WITH THE, UH, P O A OF LAKERIDGE AND WAS GRANTED THAT, UH, FENCE ON JUNE 1ST.

UH, THEREAFTER, HE, UH, HAD HIS PD AMENDMENT FILED AND THAT WAS SET FOR HEARING.

AND, UH, PRIOR TO THAT HEARING, A STAFF REPORT WAS ISSUED.

AND IN THAT STAFF REPORT IT WENT OVER THE DIFFERENT FACTORS FOR A ZONE CHANGE FACTOR ONE WAS FOUND, UH, TO HAVE NO PROPOSED CHANGE OF USE.

UM, AND IT WOULD ONLY REQUIRE RESULT IN AN AMENDMENT TO THE PD REGULATION OF THIS SUBJECT PROPERTY ONLY.

UH, FACTORS TWO THROUGH FOUR WERE FOUND TO NOT APPLY TO THE REQUEST AS THOUGH IT WAS BEING, UH, PROCESSED AS HIS OWN CHANGE AS PURSUANT TO APPLICABLE TEXAS LAW.

THE SCOPE IS LIMITED TO MR. FULLER'S ADDRESS ONLY AT THIS TIME, AS IT WAS SUGGESTED THAT HE DO THAT IN A MANNER TO ESTABLISH, UH, THE CRITERION FOR FUTURE HOMEOWNERS WHO MAY ALSO DESIRE TO HAVE A, UH, PD AMENDMENT FOR THERE IF THEY DESIRE A SECURITY FENCE IN THE LAKE RIDGE AREA AS WELL.

UH, FACTOR FIVE, UH, HOW OTHER AREAS DESIGNATED FOR SIMILAR DEVELOPMENT WOULD BE AFFECTED? UH, THE EFFECT HERE WOULD BE THAT OBVIOUSLY MR. FULLER'S HOME WOULD BE THE ONLY ONE, UH, THAT WOULD BE ALLOWED THE SECURITY FENCE IN THIS ZONING AREA AS A RESULT OF THIS AMENDMENT.

HOWEVER, THE OFFSET TO THAT CHANGE WOULD BE THAT IT WOULD ESTABLISH CRITERION FOR OTHER HOMEOWNERS TO REC, UH, TO REQUEST THE ABILITY TO HAVE A SECURITY FENCE IN THE FUTURE PURSUANT TO THE SAME CONDITIONS.

AND THEN FACTOR SIX, UH, THE, UM, AMENDING THE PD WOULD NOT HAVE ANY IMPACT ON PUBLIC HEALTH, SAFETY, MORALS, OR GENERAL WELFARE.

UH, THE STAFF REPORT INCLUDED A NOTIFICATION TO 15, UH, PROPERTY OWNERS AND 200 FOOT RADIUS.

THE REASON THAT THE STAFF RECOMMENDATION GAVE THO THAT RECOMMENDATION IS THAT SINCE THE PD AMENDMENT IS FOR ONE LOT, IT WOULD BE IMPORTANT TO ESTABLISH CRITERIA THAT COULD BE CARRIED OUT WITH FUTURE AMENDMENTS FOR OTHER PROPERTIES WITH SIMILAR REQUESTS.

THIS WILL AIM TO ENSURE CONSISTENCY OF FRONT YARD FENCING FOR, FOR ALL LOTS WITHIN THE PD BOUNDARY.

NOW, ONE THING THAT THE STAFF REPORT ALSO SAID WAS THAT THERE WAS ONLY ONE, UH, EXCUSE ME, THERE WAS ONLY ONE LIKE PROPERTY IN THE CEDAR HILL AREA.

UM, THERE ARE A FEW THINGS TO CONSIDER HERE.

SB 1588 DOES, UH, WHICH WAS PASSED OBVIOUSLY BY THE TEXAS SENATE, UH, DOES PROHIBIT A P O A FROM, UH, PROHIBITING SECURITY FENCES AND REQUIRES THEM TO APPROVE THEM, UH, SPECIFICALLY ON LOTS OF MORE THAN ONE ACRE.

UH, SO THERE, THERE IS THAT TO CONSIDER.

THERE'S ALSO HB 2127, WHICH IS MAKING ITS WAY THROUGH THE COURTS.

UM, THE ORDINANCE, THERE'S AN ORDINANCE AT ISSUE ALREADY IN CEDAR HILL THAT ALLOWS FOR SECURITY FENCES IN FRONT OF HOMES.

SO THIS RESTRICTION IS SPECIFIC TO JUST THIS PLAN DEVELOPMENT AREA AND IS NOT SPECIFIC TO THE ENTIRE CITY AND CAN BE CHANGED AND WOULD MAKE THIS LIKE THE OTHER AREAS IN CEDAR HILL.

AND THE CURRENT FENCE REGULATION IN PD 95 10, WHICH IS SOUGHT TO BE AMENDED, SPECIFICALLY STATES NO FENCING SHALL BE ALLOWED FROM THE FRONT LINE OF THE HOUSE TO THE PUBLIC RIGHT OF WAY.

HOWEVER, AS WE'LL SEE, THAT DOES NOT PROHIBIT THE EXACT TYPE OF FENCE THAT MR. FULLER IS SEEKING FROM BEING ON THE, HIS STREET, NO LESS THAN SEVEN LOTS FROM HIS HOUSE.

SO PART OF MR. FULLER'S ISSUE HAS BEEN TRESPASSING ON HIS PROPERTY SINCE HE PURCHASED THE PROPERTY IN 2021.

THERE HAVE BEEN OVER A HUNDRED INSTANCES THAT HE HAS BEEN ABLE TO DOCUMENT HIMSELF, EITHER SEEING OR OTHERWISE OF TRESPASSING ON HIS PROPERTY.

PEOPLE WHO ARE UNINVITED COMING ONTO HIS PROPERTY.

THESE PHOTOS SHOW YOU SEVERAL OF THOSE INSTANCES OF VEHICLES PARKED IN HIS DRIVEWAY, VEHICLES SLOWLY CREEPING UP TO HIS PROPERTY AND EVENTUALLY COMING ON AND THEN LEAVING HIS PROPERTY.

NOW, I COULD LIKE DOWN THE STREET, POSSIBLY HAVE COLUMNS, ALL THE 24 COLUMNS WITHOUT THE FENCING, BUT IT PREVENTS THEM SLIGHTLY, I GUESS I COULD PLANT TREES OR SOMETHING TO DO LIKE THE HOMES DOWN THE STREET.
