A DESIRE CAN EQUAL HER LONG LIFE IS IN HER RIGHT HAND IN HER LEFT RICHES AND HONOR, HER WAYS ARE PLEASANT AND ALL HER PAST PEACEFUL.

I THINK IT'S VERY FITTING THAT WE WOULD BE HAVING THE, THE ARBOR DAY PROCLAMATION TODAY WHEN WE'RE ALSO LOOKING AT ADOPTING OUR COMPREHENSIVE PLAN, WHICH INCLUDES INCREASING OPENING GREEN SPACE FROM 20% TO 25%.

SO THAT'S ALSO A BIG IMPROVEMENT AND, UH, AND ANOTHER STEP TOWARDS PRESERVING OUR GREEN SPACE.

SO LET ME, LET ME READ THE PROCLAMATION HERE FROM, FROM THE MAYOR FOR ARBOR DAY.

WHEREAS ARBOR DAY IS A NATIONALLY AND LOCALLY CELEBRATED OBSERVANCE THAT ENCOURAGES TREE PLANTING CARE AND PRESERVATION.

AND WHEREAS ARBOR DAY WAS FIRST CELEBRATED IN NEBRASKA IN 1872 WAS PASSED INTO LAW BY THE TEXAS LEGISLATURE IN 1890.

AND IT'S NOW CELEBRATED ANNUALLY THROUGHOUT THE NATION.

AND WHEREAS TREES CREATE A MOSAIC GREEN SPACE THROUGH OUR COMMUNITIES, IMPROVING PROPERTY VALUES AND AIR QUALITY, PROVIDING SHELTER FOR WILDLIFE SHADE, TO OUR COOL HOMES, TO COOL OUR HOMES.

AND WHEREAS ARBOR DAY IS CELEBRATED TO ENCOURAGE THE PLANTING OF TREES THROUGHOUT CEDAR HILL FOR THE ENVIRONMENTAL ECONOMIC AND AESTHETIC BENEFITS.

THEY PROVIDE TO THE COMMUNITY.

AND WHEREAS THE CITY WILL CONTINUE ITS EFFORTS THROUGH ITS LANDSCAPE AND TREE ORDINANCES AND ITS OFFICIAL ARBOR DAY CELEBRATION TO RECOGNIZE THE IMPORTANCE OF THE URBAN FOREST TO OUR COMMUNITY AND THE NEED TO PRESERVE IT.

NOW, THEREFORE I, STEVEN MASON MAYOR, THE CITY OF CEDAR HILL DO HEREBY PROCLAIM SATURDAY, APRIL 9TH, 2022 AS ARBOR DAY IN THE CITY OF CEDAR HILL, TEXAS FURTHER.

I ASKED ALL RESIDENTS AND BUSINESSES TO ENCOURAGE AND SUPPORT THE PRESERVATION OF TREES IN OUR COMMUNITY AND WORK DILIGENTLY TO MAINTAIN THE BEAUTIFUL LANDSCAPE TO PROVIDE FOR ALL OF US.

IT IS A NATIONWIDE MOVEMENT THAT PROVIDES THE FRAMEWORK NECESSARY FOR COMMUNITIES TO MANAGE AND EXPAND THEIR PUBLIC TREES.

UM, SO SOME OF THE THINGS THAT, UM, WE HAVE TO DO TO MEET THESE REQUIREMENTS, UM, THEY HAVE TO, UH, TO ACHIEVE TREE CITY USA STATUS, YOU HAVE TO MEET FOUR CORE STANDARDS OF SOUND, URBAN FORESTRY MANAGEMENT, MAINTAINING A TREAT BOARD OR DEPARTMENT HAVING A COMMUNITY TREE ORDINANCE AND SPENDING AT LEAST $2 PER CAPITA ON URBAN FORESTRY AND CELEBRATING ARBOR DAY.

WE ALSO COLLECT DATA ON AMERICAN INDIAN, ALASKA, NATIVE MOTORISTS, BUT THEY'RE USUALLY FOR A FEW IN NUMBER.

SO WE DON'T CHART THOSE.

THE ISSUE WITH STOCK DATA, REALLY RESEARCHERS IN GENERAL ON RACIAL PROFILE ARE MOVING AWAY FROM STOP DATA.

AND THERE'S A COUPLE OF REASONS FOR THAT.

UM, FIRST IS WE DON'T THE POPULATION MEASURES.

THAT'S WHAT TICO REQUIRES US TO COMPARE THE DATA TO THE PROBLEM IS THAT'S THE BENCHMARK.

AND THE PROBLEM IS, IS WE DON'T HAVE A QUALITY BENCHMARK FOR TRAFFIC DATA FOR TRAFFIC STOP DATA.

SO 2.4% OF THOSE TRAFFIC STOPS THOSE TO OVER 10,000 TRAFFIC STOPS.

SO THE OFFICER KNOW THE RACE ETHNICITY OF THE PERSON PRIOR TO THE STOP AND WHY THAT'S IMPORTANT AND WHY THAT KIND OF, UH, IMPACTS THE INTERPRETED VALUE OF THE CHART THAT WAS PRESENTED TO YOU IS, IS THAT OUR, OUR LAW, OUR CODE OF CRIMINAL PROCEDURE DOES DEFINE RACIAL PROFILING.

AND IT IS DEFINED AS A LAW ENFORCEMENT INITIATED ACTION BASED ON A PERSON'S RACE OR ETHNICITY.

AND SO WHAT WE END UP FOCUSING ON IS WHAT WE CALL POST-OP OUTCOMES, BECAUSE AT THAT POINT IN TIME, THE OFFICERS APPROACHED THE VEHICLE AND IDENTIFIED THE RACE ETHNICITY OF THE PERSON THAT THEY HAVE, THEY HAVE STOP.

SO ONE MORE THING ABOUT THAT 2.4%.

SO I PULLED 2019 DATA BECAUSE 2020 DATA IS IMPACTED BY THE COVID PANDEMIC.

SO I USE 2019 DATA ABOUT THIRD TICKED OUT DPS BECAUSE THEY DO ABOUT 3 MILLION TRAFFIC STOPS A YEAR, TOOK OUT BPS, TOOK OUT ANY AGENCY THAT, THAT HAD FEWER THAN 50 TRAFFIC STOPS ENDED UP WITH OVER 1300 AGENCIES, 6.8 MILLION TRAFFIC STOPS, AND 3.5% OF THE TIME THEY KNEW THE RACE ETHNICITY.

SO IT'S PRETTY CONSISTENT THROUGHOUT THE STATE.

IT'S BEEN CONSISTENT HISTORICALLY OVER TIME.

AND SO I ALSO FINALLY DID A ALSO JUST KIND OF DID LIKE WHAT'S THE NORM, OR DID A STANDARD DEVIATION.

SO THE NORM IS 0% TO ABOUT 7% OF THE TIME THAT THEY KNOW THE RACE ETHNICITY, AND THAT'S, UM, A STATEWIDE, UH, DATA ELEMENT.

SO THEN WHAT WE TURN TO IS REALLY THE, WHAT HAPPENS AFTER THE STOP.

AND SO THERE'S TWO ASSESSMENTS THAT ARE DONE.

ONE IS, WAS IT A CITATION ISSUED A WARNING ISSUE OR AN ARREST? AND THEN THE OTHER ONE IS, WAS A SEARCH CONDUCTED, IF SO, WHAT TYPE OF SEARCH? AND SO THERE'S REALLY FOUR OUTCOMES TO A TRAFFIC STOP.

WE PUT THREE OF THEM ON THIS SLIDE BECAUSE IT GETS A LITTLE FULL.

IF I PUT THE FOURTH ONE, YOU DO HAVE SOME WRITTEN WARNINGS OVER 60% OF YOUR STOPS RESULT IN A WARNING, NOT A CITATION, BUT WHAT'S PRESENTED THERE IS VERBAL WARNING, CITATION AND ARREST.

AND WHAT THIS, WHAT THESE ARE, THESE ARE WHAT ARE REFERRED TO AS COLUMN PERCENTAGES.

SO IT'S BASICALLY THE WAY TO READ IT IS, IS THAT OF THE WHITE MOTORISTS THAT WERE STOPPED 40% RECEIVED THE VERBAL WARNING OF THE BLACK MOTORISTS THAT WERE STOPPED 48% RECEIVED A VERBAL WARNING.

SO IT'S TAKING THE NUMBER OF VERBAL WARNINGS, UH, ISSUED TO BLACK MOTORISTS AND DIVIDING IT BY THE NUMBER OF STOPS, BUT BLACK MOTORISTS.

SO IT'S A COLUMN PERCENTAGE.

AND WHAT WE GENERALLY LOOK FOR HERE IS CONSISTENCY.

AND THAT'S WHAT WE SEE HERE ON THE VERBAL WARNINGS.

AND WITH THE CITATIONS ARRESTS, UH, ARE FEW IN NUMBER.

AND SO THE PERCENTAGES ARE INFLUENCED BY EITHER A SMALL NUMERATOR OR SMALL DENOMINATOR, BUT IT'S BRED THE SAME WAY OF THE STOPS OF WHITE MOTORISTS.

1% WERE ARRESTED OF THE STOPS OF BLACK MOTORS.

3.1% WERE ARRESTED.

NO ASIAN MOTORISTS WERE ARRESTED.

AND 1.7% OF THIS SPANIC MOTORISTS WERE STOPPED OR ARRESTED.

WE COLLECT DATA.

THE CITY COLLECTS DATA ON THE REASON FOR THE ARREST.

AND MOST OF THE TIME IT'S AN OUTSTANDING WARRANT.

SO THE PERSON HAS AN OUTSTANDING WARRANT.

AND SO THE OFFICER MAKES AN ARREST.

THE OTHER REASON IS A VIOLATION OF THE PENAL CODE.

SO THE PERSON HAS COMMITTED A CRIME AND THE OFFICER HAS PROBABLE CAUSE TO MAKE AN ARREST IN THAT ACCOUNTS.

AND THE TOTAL OF THAT IS 98.4%.

SO THAT'S PRETTY MUCH ALL OF THE, ALL OF THE ARRESTS.

THE THIRD ANALYSIS IS REQUIRED ON THE LAW IS A SEARCH ANALYSIS.

SO YOU HAVE 548.

SO ROUGHLY 550 SEARCHES OUT OF THE 10,500 OR SO TRAFFIC STOPS.

IT MEANS 5.2% OF YOUR TRAFFIC STOPS ENDED IN A SEARCH RESULTED IN A SEARCH.

A SEARCH OCCURRED DURING THE STOP THAT IS ALMOST SPOT ON WITH THE STATE AVERAGE.

SO THAT SAME ANALYSIS I DID WITH THE 1300 AGENCIES, 6.8 MILLION STOPS FOR 2019.

THE STATEWIDE AVERAGE FOR WHAT PERCENTAGE OF STOPS RESULT IN A SEARCH IS 5.5%.

SO YOU WERE RIGHT THERE WHERE THE STATE AVERAGE IS THE SEARCHES ON THE LEFT SIDE, THAT SHOW WHITE MOTORS, 1.9% BLACK MOTORS, 6.7%, HISPANIC MOTORISTS THREE POINT PERCENT AND ASIAN MOTORS.

1.4% IS RED THE SAME WAY AS THE WARNINGS AND CITATIONS AND ARRESTS.

IT'S A COLUMN PERCENTAGE.

SO OF THE WHITE MOTORISTS THAT WERE STOPPED, 1.9% WERE SEARCHED OF THE BLACK MOTORS THAT WERE STOPPED.

6.7% WERE SEARCHED OF THE SPANISH MOTORIST THAT WERE STOPPED.

3.5% WERE SEARCHED.

YOU KNOW, THE ASIAN MOTORISTS THAT WERE STOPPED.

1.5%, 1.4% WERE SEARCHED.

SAME AS WITH THE ARRESTS.

WE HAVE THE REASON FOR THE SEARCH, ALMOST ALL OF YOUR SEARCHES THAT ARE CONDUCTED BY CEDAR HILL POLICE OFFICERS ARE BASED ON PROBABLE CAUSE.

SO THE OFFICER HAS ARTICULABLE FACTS TO BELIEVE THAT THERE IS EVIDENCE OF A CRIME, UH, EITHER ON THE MOTORIST OR INSIDE OF THE

AND THAT'S A GOOD THING BECAUSE WE DON'T WANT TO SEE A LOT OF CONSENT SEARCHES DURING, UH, TRAFFIC STOPS BECAUSE THOSE ARE THE DISCRETIONARY ONES.

AND THEN THE QUESTION BECOMES, WHY ARE YOU ASKING THAT PERSON FOR CONSENT TO SEARCH? THE LAST THING THAT WE ASSESS ON THE SEARCHES IS WITH CONTRABAND DISCOVER.

THERE WAS ONE COMPLAINT MADE BY A CITIZEN, A MOTORIST THAT ALLEGED THAT AN OFFICER, UH, ENGAGED IN RACIAL PROFILING, UH, POLICE DEPARTMENT WENT THROUGH THE INVESTIGATIVE PROCESS AND THE OFFICER WAS EXONERATED, UH, REGARDING THE COMPLAINT, WHICH BASICALLY MEANS THAT THE, THE ALLEGATION OF RACIAL PROFILING DID NOT, DID NOT OCCUR.

UH, EXCEPTIONALLY WELL AS MS. PETTIS SAID, WE HAVE CONCLUDED OUR AUDIT.

WE HAVE ISSUED AN UNMODIFIED OPINION ON THE FINANCIAL STATEMENTS, WHICH IS THE HIGHEST LEVEL OF ASSURANCE THAT WE CAN PROVIDE.

SO, SO TO ME, I WAS PRETTY IMPRESSED WITH, WITH THE PROCESS, VERY WELL, SUB COUNCIL MEMBERS REGARDING, UM, I JUST WANT THEM TO SOLICIT FROM YOU, UH, SOMETHING YOU HAD MADE, YOU MADE A COMMENT, YOU KNOW, UNSOLICITED IN OUR, IN OUR LAST AUDIT MEETING THAT I BELIEVE YOU SAID THAT THIS WAS THE CLEANEST OR ONE OF THE CLEANEST AUDITS THAT, UH, THAT YOU WOULD HAVE EVER SEEN FOR THE CITY OF CEDAR HILL.

YES.

BUT I WOULD ALSO COMPARE IT TO, AUDITOR'S ALWAYS ONLY, WE REALLY ONLY KNOW HOW TO SPEAK TO THE NEGATIVES, BUT, UM, YOUR FINANCE STAFF IS TOP-NOTCH, UM, THEY WORKED VERY HARD, UH, THROUGHOUT THE ENGAGEMENT.

UH, I WOULD CLASSIFY IT AS A VERY QUALITY AUDIT, UM, OKAY.

IF I HAVE A FEW COMMENTS, BUT, UH, THEY WERE PROTEST, SO DON'T GO TOO FAR, BUT QUESTION STAFF, IT WASN'T FOR YOU, BUT I WANTED TO MAKE SURE THE COUNCIL UNDERSTOOD ITS ROLE IN THIS PROCESS.

SO, UM, WE HAD, UM, GET A LITTLE BIT OF HISTORY.

WE HAD, UH, A, UH, AN OUTSTANDING FINANCE DIRECTOR WHO WAS LIKE THE LONE RANGER THAT DID EVERYTHING.

AND I REMEMBER DOING THE AUDIT PROCESS.

HE WAS, HE, UM, I HAD A GREAT RELATIONSHIP WITH HIM, BUT, UH, WHEN THE AUDIT WAS GOING ON, HE WAS LIKE, DON'T TALK TO ME, LEAVE ME ALONE.

HE WAS UNAPPROACHABLE.

AND THAT'S BECAUSE HE WAS A LONE RANGER, BUT, AND DURING THAT TIME, WE WERE GROWING AS A CITY AND EVERY YEAR WE WERE ADDING POLICE OFFICERS AND FIREFIGHTERS, AND WE COULD NOT AFFORD TO ADD THE STAFF THAT WAS NECESSARY TO GET US TO WHERE WE ARE TODAY, WHERE WE EVENTUALLY GOT TO THE POINT WHERE WE BROUGHT IN ADDITIONAL STAFF, PEOPLE THAT, UH, HELPED THIS PROCESS.

AND SO WHAT WE SEE TODAY IS A RESULT OF COUNCIL ACTIONS OF ABOUT PROVIDING THE RESOURCES THAT THE FINANCE DEPARTMENT NEEDED TO PRODUCE THE PRODUCT THAT WE HAVE TODAY.

NOW WE STAND HERE TODAY AND WE SAY, WE HAVE AN OUTSTANDING AUDIT AND IT'S GREAT IN, BUT IT WAS BECAUSE OF THE COUNCIL'S ACTIVITIES OVER THE YEARS TO PROVIDE THE RESOURCES, TO GET TO WHERE WE ARE TODAY.
