UM, A QUORUM OF THE COUNCIL IS PRESENT.

THE AGENDA HAS BEEN DULY POSTED, UH, LIKE TO MAKE SURE EVERYONE KNOW THAT CONCEALED CARRY CARRYING OF FIREARMS IS PROHIBITED IN THE COUNCIL CHAMBER.

UM, TONIGHT WE WILL HAVE, UH, THE INVOCATION OF BY OUR VERY OWN PASTOR VICTOR JACKSON, THAT WILL BE FOLLOWED BY THE PLEDGE OF ALLEGIANCE FOR THE ASCE COUNCIL MEMBER HAYDEN.

IF HE WOULD LEAD US IN THE PLEDGE OF ALLEGIANCE, UH, PASTOR VICTOR JACKSON FOR 10 YEARS, AS FAITHFULLY AND JOYFULLY SAID, BUILDING THE KINGDOM COMMUNITY CHURCH, ALONG WITH HIS WIFE, RAMONA AND BEFORE PLANNING, UH, BUILDING THE KINGDOM COMMUNITY, THE CHURCH PASTOR VIC WORKED IN A VARIETY OF CAPACITIES, FARMING AND SERVICES.

UH, THESE ARE THEY CHURCH.

UH, PASTOR VIC JOINED DALLAS FIRST CHURCH AND BECAME THE FIRST AFRICAN AMERICAN PASTOR OF THE NAZARENE DENOMINATION.

UH, WHAT A LOVING, I LOVE YOU PHILOSOPHY, PASTOR VIC HAS DISCOVERED THAT THOSE WHO SERVE IN MINISTRY REALLY GROW IN THEIR RELATIONSHIP WITH GOD AS THEY SERVE HIM AND OTHERS.

WOULD YOU STAND FOR THE INVOCATION? THANK YOU SO MUCH.

UH, PRO TIM ALLEN SAMS, AND I WANT TO PRAY IN THE ABSENCE OF A MAYOR.

UH, KNOW WHAT'S GOING ON WITH HIM, BUT I KNOW HE'S NOT HERE.

SO I WANT TO MAKE SURE I PUT HIM IN MY PRAYER.

HEAVENLY FATHER, WE COME ONLY BECAUSE YOU HAVE ALLOWED US TO COME.

IT'S NOTHING IN AND OF OURSELVES THAT HAVE GOTTEN US TO THIS POINT IN OUR LIVES.

AND FOR THAT WE SAY, THANK YOU.

AND WHAT I ASKED THAT YOU WOULD BE IN THE MIDST OF THIS MEETING, THAT THE LOVE THAT YOU DISPLAY FOR EACH AND EVERY ONE OF US, WE WILL DISPLAY THAT SAME LOVE TO EACH OTHER, FATHER, GOD, WE CAN AGREE TO DISAGREE, BUT FATHER GOD LET'S AGREE TO LOVE.

UM, A COUPLE OF THINGS THAT I WOULD SAY I'D LIKE TO, UH, MAKE A SPECIAL NOTE OF, UH, WE HAVE PROFESSOR ANGELA PHELPS AND HER GOVERNMENT AND ECONOMICS CLASS.

WOULD YOU JUST WORRY ABOUT SO EVERYBODY CAN KNOW WHO YOU ARE, APPRECIATE THOSE THAT HAVE EXPRESSED INTEREST IN GOVERNMENT.

ON TO THE AGENDA, THE FIRST ITEM ON THE AGENDA IS THIS CITIZENS FORUM.

YOU WILL HAVE THREE MINUTES, CORRECT ME IF I'M WRONG, BUT I UNDERSTAND THE CITY LIMITS RESIDENCE DUE TO GARAGE SALES A YEAR AND WE'RE SUPPOSED TO OBTAIN A PERMIT.

I DOUBT THAT ENFORCEMENT IS A BIG PRIORITY, BUT IT DOES PROVIDE A TOOL TO PREVENT FOLKS FROM MONEY AND RESALE OR RETAIL BUSINESS OUT OF THEIR GARAGES.

ARE THERE RESTRICTIONS? I'M ASSUMING THEY ARE TO WHAT STORES CAN BE USED FOR IN CEDAR HILL.

FOR EXAMPLE, COULD I MAKE A RESIDENCE IN A STORE OR USE IT AS A PO MOTEL? BUT IF I BUY A HOUSE AND AS IN ANY RESIDENTIAL AREA, HOA OR NOT, I CAN USE IT AS A MOTEL, WHICH IS EXACTLY WHAT A SHORT-TERM RENTAL IS.

THESE SHORT-TERM RENTALS ARE ANALOGOUS TO THE SO-CALLED LEMON SOCIALISM, WHERE PROFITS ARE PRIVATIZED AND RISKS OF SOCIALIZED.

THE ADVANTAGE OF SHORT-TERM RENTALS, INCREASED INCOME ARE REPAYING INDIVIDUAL PROPERTY OWNERS.

WELL, THE DOWNSIDES ARE BORN BY THE COMMUNITY AS A WHOLE, A QUIET SLEEPY NEIGHBORHOOD THAT ALL OF A SUDDEN HAS VACATIONERS STANDS.

A GOOD CHANCE OF LOSING ITS QUIET, SLEEPY NATURE, THE HOLIDAY AND NEEDS, PERMITS AND LICENSES.

AND THEY PAY A HOTEL TAX TO THE CITY AS A COST OF DOING BUSINESS.

DOES THE CITY IMPOSE A MOTEL TAX ON THESE SHORT-TERM RENTALS? IF NOT, WHY NOT? DO THEY NEED A PERMIT, A LICENSE? AND IF NOT, WHY NOT? ARE THEY BEING USED AS BNBS BREAD IN VEC BREAKFAST? DO YOU KNOW IF FOOD IS BEING SERVED, THEY ARE A BNB AND SHOULD BE REQUIRED TO MEET THE STATE'S REQUIREMENTS AND BECAUSE DEFIED AS A FOOD ESTABLISHMENT AND COMPLY WITH THOSE STATE REGULATIONS AS WELL, UH, THOSE HOUSES THAT DO SHORT TERM RENTALS, OWNER OCCUPIED, DO THEY HAVE A HOMESTEAD EXEMPTION? IF THEY'RE NOT OWNER OCCUPIED, DO THEY HAVE A HOMESTEAD EXEMPTION? ANYWAY, THE IDEA THAT THESE SO-CALLED SHORT-TERM RENTALS SHOULD BE CONTROLLED BY HOS IS QUITE FRANKLY RIDICULOUS.

THE BURDEN IS TREMENDOUS.

ONE LAW FIRM, JUST ONE LAW FIRM, J PATRICK SUTTON HAS FILED 20 LAWSUITS AGAINST HOS IN 2021.

HE ARGUES THAT HIS CLIENT'S RIGHTS ARE BEING TAKEN AWAY BY AMENDMENTS TO CONSTRUCTIVE TOO RESTRICTIVE COVENANTS.

HOW MANY OTHER FIRMS HAVE, OR WILL FILE SIMILAR LAWSUITS REGARDLESS OF HOW THESE LAWSUITS TURN OUT.

AND IT WILL PROBABLY TAKE YEARS.

IT IS POSSIBLE THAT INDIVIDUAL HOS ARE GOING TO HAVE TO PONY UP A LOT OF MONEY TO DEFEND THEIR POSITION, WIN OR LOSE WHILE AIRBNB AND OTHER SUCH CORPORATIONS CONSIDER LAWSUITS AND ADVERTISING DURING FOOTBALL PLAYOFFS, JUST THE COST OF DOING BUSINESS.

THERE ARE OVER A DOZEN ASSOCIATIONS IN CEDAR HILL.
